About These Terms
These Terms of Service ("Terms") govern your use of the Miami Market mobile application (the "App") and related services operated by Neil Convenience LLC, doing business as Miami Market ("Miami Market", "we", "our", "us"). Neil Convenience LLC is the legal entity behind the Miami Market brand and is the registered sender of the SMS messages described below. By creating an account or placing a pickup order, you agree to these Terms. If you do not agree, do not use the App.
Accounts and Verification
To use the App you must create an account with a valid mobile phone number. We verify that number by sending a one-time passcode (OTP) by SMS. You are responsible for keeping your account and device secure, and for all activity that occurs under your account. You must be at least 13 years old to create an account.
Orders and Pickup
All orders placed through the App are pickup orders collected in person at our store. Prices, menu availability, and pickup time slots are shown in the App and may change at any time. We may refuse or cancel an order if an item is unavailable, if a pickup slot is full, or if we suspect fraud. You may cancel an order within 5 minutes of placing it, provided our kitchen has not yet accepted it. After that point, an order can only be cancelled by our staff.
Payments and Refunds
Card payments are processed by Stripe, Inc. Miami Market does not collect or store your full card number or CVV. You may also choose pay-on-pickup at checkout where offered. Refunds for cancelled orders are issued to the original payment method. Refunds may take several business days to appear on your statement depending on your bank or card issuer.
Loyalty Points
Loyalty points are earned on completed orders and may be redeemed for discounts subject to a minimum redemption threshold shown in the App. Points have no cash value, are not transferable, and may not be sold or exchanged. We may adjust earn rates or expire points with reasonable notice.
SMS Messaging Program Terms
Program name: Miami Market Account Verification. Program description: Neil Convenience LLC sends one-time passcodes (OTP) by SMS so you can verify your phone number and sign in to the Miami Market app. This is a transactional, account-security program. We do not send marketing or promotional text messages through this program. How to opt in: You opt in by entering your mobile phone number on the sign-in screen of the Miami Market app and tapping "Send OTP". The sign-in screen displays a consent notice stating that by continuing you agree to these Terms and our Privacy Policy and that standard SMS rates may apply, with a link to this page for the full program terms set out below. Tapping "Send OTP" constitutes your express consent to receive a one-time verification code by SMS at the number you entered. Consent to receive these messages is not a condition of any purchase. Message frequency: Message frequency varies. You receive one message each time you request a verification code — typically 1 to 3 messages per month. Cost: Message and data rates may apply. Miami Market does not charge for these messages; your mobile carrier's standard rates apply. How to opt out: Reply STOP to any message from us to stop receiving SMS messages. You will receive a single confirmation message and no further messages. Because verification codes are required to sign in, opting out means you will no longer be able to sign in to the app by SMS; contact our support team for assistance. How to get help: Reply HELP to any message from us, email support@miamimarket.app, or call (513) 831-8646. Carriers: Carriers are not liable for delayed or undelivered messages. Message delivery is subject to your carrier's network availability. Privacy: We do not sell, rent, or share your mobile number or SMS opt-in data with third parties or affiliates for their own marketing purposes. Mobile information is used solely to deliver your verification codes. See our Privacy Policy for full details on how we handle your information. Supported carriers: Message delivery is supported on major U.S. carriers. Carrier support may change without notice.
Push Notifications
Separately from SMS, the App may send push notifications about your order status and, if you opt in, promotional offers. You can manage notification preferences inside the App or disable push notifications entirely in your device settings.
Acceptable Use
You agree not to misuse the App. In particular, you must not attempt to gain unauthorised access to any account or system, submit false or fraudulent orders, interfere with or disrupt our services, reverse engineer the App, or use the App for any unlawful purpose.
Ratings and Submitted Content
You may submit star ratings and written comments after picking up an order. Do not submit content that is unlawful, abusive, defamatory, or that infringes anyone's rights. We may remove any submitted content at our discretion. By submitting content, you grant us a non-exclusive licence to display it in connection with our services.
Disclaimers
The App and our services are provided "as is" and "as available" without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the App will be uninterrupted, error free, or free of harmful components. If you have a food allergy or dietary restriction, please speak to our staff directly before ordering. Menu descriptions in the App may not list every ingredient.
Limitation of Liability
To the fullest extent permitted by law, Neil Convenience LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. Our total liability for any claim relating to an order will not exceed the amount you paid for that order.
Changes to These Terms
We may update these Terms from time to time. We will update the "Last updated" date at the top of this page and, where the change is material, notify you through the App. Your continued use of the App after a change takes effect constitutes acceptance of the updated Terms.
Governing Law
These Terms are governed by the laws of the State of Ohio, United States, without regard to its conflict of law provisions.
